Selling or Giving Away a Dog or Cat

From 1 July 2019, anyone advertising kittens, cats, puppies, or dogs for sale or adoption in NSW must include an identification number in the advertisement.

This number can be either:

  • a microchip number
  • a breeder identification number
  • a rehoming organisation number

Advertising requirements

These rules apply to all forms of advertising, including:

  • newspapers
  • posters or noticeboards
  • online platforms such as Trading Post, Gumtree, and social media

Fines may apply for non-compliance.

Enforcement

The following agencies can enforce these advertising requirements under the Prevention of Cruelty to Animals Act 1979:

  • RSPCA NSW
  • Animal Welfare League NSW
  • NSW Police

Local council officers do not have enforcement powers.

Greyhound Welfare and Integrity Commission

For greyhounds, the Greyhound Welfare and Integrity Commission enforces compliance when advertised by registered greyhound racing participants.

Transfer ownership

When you're satisfied you’ve found a good home for your pet, you must transfer ownership to the new owner.

It’s important to check the transfer has been completed and the new owner has accepted responsibility.
